1) DEFINITIONS

“Client” means the person or organisation to whom the invoice is addressed to (whether or not the Client is acting for a third party).

(b) “Photo” means any photograph, transparency, negative, design, digital image file or any other item which may be offered for the purpose of reproduction taken by Natalie & Max Photo & Films.

(c) “Photographer” means Natalie & Max Photo & Films [Ware, Hertfordshire/ Surfal, Portugal]

(d) “Videographer” means Natalie & Max Photo & Films [Ware, Hertfordshire/ Surfal, Portugal]

2) SERVICES

This is a contract for wedding photography / wedding videography services and products provided by the Photographer(s)/ Videographer(s) to the Client, the details of which are [set out above/have been agreed by both parties].

3) THE EVENT / WEDDING

a) The Photographer(s) / Videographer(s) agrees to be in attendance on the date of the event and to provide the Client with the Photography and or Videography package [set out above/agreed with the Client].

b) If the Photographer or Videographers is unable to attend the wedding/event due to illness or any other unforeseen circumstances, a suitable replacement Photographer(s) / Videographer(s) will be provided by Natalie & Max Photo & Films

c) The Client confirms that the bride, groom and any guests present at the wedding can be photographed / filmed without any further permission. If the Client or any of the guests have any concerns, the Client must notify the Photographer(s)/ Videographer(s) as soon as possible.

4) PAYMENT AND CANCELLATION

a) The payment by the Client of a non-refundable deposit in an amount equal to 30% of the total price of the Photography / Videography package (the “Deposit”) shall secure the booking for the selected wedding date. The Client acknowledges and agrees that in the event of any cancellation by the Client, the Deposit is non-refundable and non-transferable to any other products or services.

b) Natalie & Max Photo & Films shall invoice for the full remaining balance in two separate equal instalments. The Client agrees to pay the final instalment for the Photography / Videography package purchased by no later than 45 days before the agreed wedding date. Failure to do so will be seen as a breech of this contract and the entirety of our services will be cancelled for the specified date and any other dates. The Client acknowledges and agrees that in the event of any cancellation by them, all instalments paid by the Client are non-refundable and non-transferable to any other products or services.

c) Subject to paragraph d) below, in case of postponement of the wedding by the Client, every effort will be made to accommodate the new chosen date however if the Photographer / Videographer already has a booking on the new chosen date and is therefore unable to accommodate the postponement, the booking will be classed as a cancellation and the Deposit and all payment instalments paid by the Client shall be non-refundable and non-transferable.

d) If the Client changes the date of the wedding after the payment of the Deposit and the Photographer / Videographer is available on the new chosen date, an additional fee of an amount equal to 30% of the total price of the Photography/ Videography package shall be payable and must be paid by the Client in order to secure the booking for the new wedding date.

5) Artistic Rights & Editing Style

a) The Photographer retains the right of discretion in selecting the photographic materials released to the client.

b) The client agrees to have seen the online portfolio and enough examples of the photographer’s work to agree to their editing style and will make no petitions to change this after the images have been delivered.

6) COPYRIGHT

a) The copyright and all other rights in any Photos/ Films taken remain the property of the Natalie & Max Photo & Films and the Client acknowledges that any Photos / Videos taken at the wedding/event may be used by the Natalie & Max Photo & Films for advertising, competitions or promotional purposes.

b) Following the event/wedding, all Photos / Videos will be uploaded to a password-protected private wedding gallery to be viewed by the Client and their guests. A password will be provided to the Client after the photos/Videos have been uploaded. It is the Client’s responsibility to inform Natalie & Max Photo & Films if they require any Photos/ Footage to be removed from the online viewing galleries.

c) If, as part of the Photography / Videography package, the Client is provided with a digital files containing Photos/ Videos, the Photos/ Videos may be printed and/or displayed online for personal use but in no circumstances can they be used for commercial activities unless agreed in advance and in writing by Natalie & Max Photo & Films.

7) EXCLUSIVITY

The Client agrees that the Photographer/ Videographer shall be the only professional wedding photographer/ videographer present at the wedding (unless otherwise agreed by Natalie & Max Photo & Films in writing prior to the wedding). If there are any requirements for photographs or video (or any other media) professionals to be present then this shall be discussed and agreed with Natalie & Max Photo & Films in advance in order to ensure the best possible experience and product for the Client.

8) TRAVEL

a) The Client agrees that travel up to a 30 mile radius from Natalie & Max Photo and Films [Ware, Hertfordshire] is included in all UK products, services or collections. Anything outside of this radius will be charged at £1 per mile.

b) The Client agrees to the terms that up to £120 per person for flights is included for all destination products, services or collections on the bases of travelling the day before the date of their event and returning the day after their event. Travel must be booked by the Photographer(s) / Videographer(s) from the nearest airport to Natalie & Max Photo and Film landing at nearest airport to the clients venue. The flights must include one large cabin bag per person and one handheld travel bag per person. If the total flight cost exceed £120 per person the client agrees to pay the difference.

c) The Client agrees to the terms that if the location of their event is outside of the UK and is not easily reachable via public transport, car hire is required. Car hire must include the day before the event date until the day after the event date. The Client agrees that the cost of the car hire will be covered by the client.

d) Natalie & Max Photo and Films agree to cover the cost of their accommodation in the UK and the EU including the day before the event date until the day after the event date. Unless otherwise agreed in writing by the Client before booking.
